I’m working on an case study a lecturer has given me, and I’ve got stuck on a particular line. It’s either a red herring (this lecturer does tend to put the odd bit of irrelevant information in to trip people up), or something I’ve forgotten about.

I’m working out a taxpayers tax liability for the year 2007/08. He’s got a nicely complex set of tax affairs, including operating as a sole trader and having a part-time job. One of the matters to deal with is the sale of “an antique painting (a non-business asset) for £45,000 which he purchased for £5,000 in January 1995. Proceeds from the sale have been invested in his business”.

I was thinking this was pretty straightforward: proceeds on sale less purchase price, apply indexation allowance to April ‘98 and taper relief for the remainder. What was confusing me was the ‘invested in the business’ part. Does this make any difference?

I’ve been racking my brain and searching through my notes and all I can come up with is Rollover Relief for chargeable gains. But isn’t that for selling a business asset and using the proceeds to buy others of the same class? Which means it doesn’t apply. But isn’t there something somewhere about selling personal assets and using the proceeds to invest in your own business? Or am I making it up?

Any suggestions would be appreciated.

EDIT: just to clarify, this is for the 2007/08 tax year. I know we’re in 08/09- the exam is even going to be in 2009/10- but the course is using 07/08 rules.
